one of the rights granted to a property owner with fee simple ownership is that they can be greedy if they want to. The boundaries are defined even below that water's surface. Sounds to me like you wouldn't be greedy if you owned the land but I guess that's irrelevant in this case.

Plus - based on your post about the pot load of ducks on the lake and it's exact location...if it were public you would be luky to have a spot since some lurker will beat you to it (or will try to seek permission from said greedy ole man before you can get to them).

Some of these greedy ole folks don't want to assume the liability of someone getting hurt on their property. I would weigh the consequences of a trespass violation over a limit of ducks. just my .02.

I lease a couple of water sheds and there is no question about it. They are private.

but you got to look at it this way, all of the land owners like us b/c we repsect them as well as thoer property so we dont have that problem

Your not talking about my buddy Mr. O callaghan. He has always been nice to me. I really never tried that spot. Let me see what I can do. When we get through limiting out we could go to John's Place for lunch.

how do your "friends" get in there ? maybe they got permission and you don't ? you wouldn't take advantage of your "friends" hunting hole, would you ?

I have had permission to hunt most of that lake for years. I obtained permission each year from the primary owner. This owner has most of the best area to hunt. This owner has turned the land over to his son in laws. I lost my hunting rights when that happened. They do duck hunt. I don't blame them, because if my family had owned it. I would have tried to control it long ago.

I still have permission from some of the other owners and can access with a little work. But most of the best hunting is on the primary owner. I know the property lines very well out there. (i'm a land surveyor). You have to be careful to know that you are on the land where you have permission.

While this lake has generally had some good duck hunting. Limiting out is rare, if you hunt legal hunting times. It was a great place for me to go and kill a couple of ducks and get to the office by 8:30. I really miss being able to do that.

It would never handle the pressure of more than a couple of groups hunting a couple of days a week.

I think the other 5 would care more than you think. that place used to be okay, but since they have put edgewater in, that place is real touchy.

I don't know about all watersheds. But the watersheds in our area were built by Town Creek Master Water Management Agency. They buy an easement to store water, to a certain elevation, to prevent downstream flooding. They are not a perminate lakes. Some of the spillways have been closed up some so they hold water year round. Town Creek has the right at any time to open the spillway or blow beaver dams that make the lake hold water.

In general the creeks leading to them are on private land and would not be navagable if the lake was not holding some water. Each owner has the right to use their own land as they see fit as long as they do not change the designed volumne of water that can be held for short periods.

If I own property that falls in the watershed easement. I have the right to limit who can access that property. No blanket permission can be given by any owner or Town Creek.

He is very adament about people not hunting on him. I think it is mainly his wife. She called me a few years ago to warn me that she was getting all the other land owners together to stop the hunting. I told here that the owners of the property that I had permission to hunt would not stop hunting. But I respected that she did not want hunting on her property and I would not get on her property. She then saked if I would shoot her pet ducks. I asked if they were white or Mallards. She told me mallards. I told her that if they came to my decoys, they were dead. She hung up.

that lake is more of a neighborhood now, than a duck hole. Usually holds a good # of ducks and used to be great hunting until all the devewlopment around there.

haha that woman tole me the same thing??? I was like are they banned?? She said maybe...I said well even if they are I will shoot them...I wasnt even around there property when I was hunting she stoped me on the way out...

she just didnt want anybody hunting...even if its NOT ON HER LAND which its not her land...I can get permission about once a season to go from the people that own most of it...I go to church with the woman who owns the land
