Accident question/advice

Postby lowbar » Mon Nov 08, 2010 10:05 pm

I have been hesitant to discuss or ask for advice about my recent accident. I recently t-boned an f150 on my honda shadow. I came out wit a few fractures and aches and pains. I just don't know where it goes from here. Do I just wait for an offer from his insurance or what. I really don't want to get a lawyer involved unless I have to. I'm sure I'll get answers from lots of perspectvies(agents, adjusters, lawyers etc) so that should be intestesting. I'm not trying to becoma a millionaire but I want what I got coming.. Beeen messed up aout a month now. didn't even get to take my boy on opening day and man was he dissapointed. did get to go out yesterday but no luck. I anyone can can give some sound advice I would apreciate it it a pm. Thanks. And BTW remember to watch out for motorcycles

I will discuss and let you know what happened on mine in a PM once I understand better.

Who was at fault by police report?
You on the motorcycle im guessing or truck?
How long ago did it happen? Guessing a month or so by statement.

If you want shoot me a PM and let me know. Sure others will probably ask the same things possibly.
May the wind always be at your back and the sun upon your face, and may the wings of destiny carry you aloft to dance with the stars.
Cheers, Georgie.

I'm confused on a couple points. If you t-boned the F-150, how is it their fault? Just having a hard time picturing the scenario.

Im guessing somebody didnt see him and pulled out in front of him. My advice...dont wait on the other guys ins. co. or you'll be waiting a long time.Dude, get a lawyer...the other guys company will stick it in and break it off if they can. Your insurance should be up thier booty...as should your laywer...hope your feeling better

Work with your agent. If I'm not mistaken your company can/will cover your medical expenses or what have you, and then will bill his company.

Exactly, if it was his fault........his insurance company isn't going to just pull out their check book and make you happy. You have to find a good lawyer and get them to go through the motions. You won't have to pay anything out of pocket.......they'll usually do it for a percentage. The hardest thing in our society today is to get an insurance company to pay what they owe.....it's all a game to them to not pay.

The only reason to "lawyer up" is IF his insurance company doesn't adequately compensate you for medical bills and repairs. As a law student I'm glad to see everyone's so sue happy, but damn it makes society look bad. (And maybe it's just my experience and mine alone, but out of the 3 accidents I've been involved in, both with and without fault, I have never needed an attorney and neither has the other party).

I know you've given them a month but give them time and work with your agent. I'm sure they will pay out if their insured is truly at fault as you said they have said. One reason premiums are high? Because people jump the gun and sue the company, which costs them more money and in turn costs you more money. Hate you got hurt though man. My uncle had to lay his down one time and broke his forearm and elbow.

Why would you get a lawyer if you don't even know what the adjuster is going to offer? You will be paying someone 1/3 of the money that is owed to you, and he will do no work to earn it. Adjusters don't make offers any differently if there is an atty involved or not, plain and simple. It would help if you said what company was at fault. Keep up with your bills and submit them to the adjuster, he will make an offer based on your injuries. You people who rush out and get an atty are pissing away money. The adjuster would probably prefer you hire an atty though, much less work for him.

In this economy, you can't talk an atty into filing suit. Juries don't give money away right now.

Yeah that's kinda been my stance through the whole thing. I may be stupid and naive but I'm gonna let it play out and see what happens. Still looking at a couple of weeks physical therapy so it ain't over. I've just been told by other friends to not sign anything and a lawyer could be brought in at any point if i decide to go that route.

There is no reason to go through your own company, but they will pay your med pay on your policy if you want them to. It just tends to complicate things. The adjuster isin't going to offer you anything until you are completely finished treating, at that time he makes an offer. When you have agreed on a price, you sign liability releases and get paid. Simple as that. It's a sit and wait game.
