Well I got burned again.

Postby MSDuckmen » Thu Sep 05, 2002 11:06 am

I did a stupid thing again. I trusted a stranger.

I had a gun for sale and a Guy came through called me late one night and said he wanted to see the gun and I told him to come on over.
He came over and talked for a while and decided he wanted the gun and ask if he could write a check. I told him I prefer cash and he said he didn't have enough and assured me it was good and gave me his driver's licence and all for ID.
Just happens Mr Anthony C Clark Sr from Natches Ms has moved closed all bank accounts and left no forwarding address and scammed me out of $400.00. I have his drivers licence number but chances are that will do me little good.

Never again will a trust another stranger, This guy was good and made me feel like I was doing the right by him and him by me.

Live and learn

Pay a visit to the Rankin county worthless check unit at the District Attorney's office. It may take a while, but they should be able to get your money back for you. You may have to send 2 certified letters to him before they can do anything with it.
Or, if nothing is done, the gun was basically stolen from you right? Report it stolen. Being caught with a stolen firearm is a felony. It would probably never get your gun back or the 400 bucks, but might give you some satisfaction of knowing that the guy's actions may catch back up with him. Either way, good luck.

Duckmen, your district attorney's office has a "bad check division" that can usually help in these cases. It may take a while but eventually they'll come through. We had the same problem on a $20,000 check and the DA was very helpful and he told me he would do the same no matter if it was $20 or $200,000. Good Luck

Looks like me and Hyena had the same idea.

We use our local district attorney's bad check division in collecting nsf checks on rentals (apartment). It takes some time, but they do collect. I highly recommend that you pursue this avenue.

IF, you got his DOB & SSN off the DL there is no place he'll be able to hide for long.

When I lived in the Magnolia state ('76-'86) it was a felony to knowlingly "utter" a hot check.

Plus, if he's crossed a state line with an illegally obtained firearm, the ATF boys might be interested in his whereabouts.

Gotta watch those Adams county folks!

Sorry for your loss but don't give up (just yet) upon the human race.

Likewise Duckmen, if you cant get anything on this guy PM me and Ill see what I can do. If you have all his info (social, DOB, etc.) and he actually gave you a valid license(surely you looked at the picture) then he cant hide for to long. Check your state laws, Im not sure about Miss. but in TN the amount of the check (or theft) constitutes wether or not it will be a felony or misdemeanor. Usually over $500 is felony, under is misd. Whatever you do make sure you follow up on getting a warrant on this guy for passing bad checks (or whatever the correct charge for your state is) even if you dont find him personally a warrant will follow him where ever he goes, and usually at the most inconveniant time he will pay for his mistake.

Ah ain't no "stinkin" lawyer but it's highly likely that since he (apparently) knowlingly gave you a worthless check the "contract" (buy/sale) between you two for the gun was/is null & void from inception.

Therefore, before/if this fella commits a felony with "your" gun it might be prudent to contact the authorities (and maybe even a "stinkin" lawyer) to ascertain your responsibilities/options.

Duckmen,

I am a bail bondsman, and we have our ways of finding folks. If you pm me the info, I might be able to track him down for ya. If his social is the same as his license # is booty is grass.
Throw away those Wal-Mart calls and go get you a Rich-N-Tone!

Good luck Duckmen. Sounds like these fellas have you pointed in the right direction. Also, if you persue the stolen weapon avenue and he is convicted he will no longer be able to posses any firearm or hunt lawfully. Good luck!

Well let me give you an update on the Scam. I at least know that the driver lic. Numbers is correct and have more history on the guy than you could believe. Seems to me that he has other warrants for checks outstanding and I have chose to file criminal charges against him. I have met with the DA’s office and the ATF and he now has a Felon Charge of False pretence to obtain a firearm, thief through fraud, which will get him up to 10 years in a Federal Penal system.
The man came in my home lied out right to me knowing that the account was closed, Knowing his address was not correct, knowing his phone had been disconnected. I have Three witnesses to the transaction and I’m Pizzed about the entire deal. If the man came tomorrow and gave me the money and all it cost me for what I have had to do. I would be willing to drop the charges. However when I go Monday to file the claim with ATF I will not be able to drop those charges as I was told they file them and prosecute.
This entire deal has caused me a great deal of grief and resentment and I don’t like feeling this way. I trusted another person and have found out that he was not worthy of trust. Makes me so fricken mad I could beat him within an inch of his life. Over 400.00 sad isn’t it. Well I don’t know why God has elected me to carry this burden but I will try to keep him in mind as I go through the legal system. Today I will check on Civil side of it and file there also. Found out that he may be an ex-con and my not be allowed to have a gun period. If this is the case he will be doing more time.

Isn't life grand
