This was in the CL today (short version) 2 17yr olds tresspass on Amtrac land climb on top of a rail car get their booty in some high voltage wire's get burnt up but live.They are now in their 20's sue Amtrac and get 24mill. because no sing's posted about the wire's.I feel for the kid's but they were the one's in the wrong for being where they had no bussness being,should have charged them for tresspassing and made their folk's pay for any damage their actions caused to lines and anyother property affected.This is the kinda of stuff killing property owners today tresspass where land is clearly posted get hurt sue owner with no consequnice to tresspasser for brakeing law to start with.Only in our great country.

Unbelievable!!!!.....well, the more I think about it, I guess it's really not that unbelievable. Anyone in the legal field care to respond?

Ya know that's funny too I'm dealin with a tresspassin problem as we speak. Go out to company land and it's a lock on it that aint ours and two perty green patches planted. To say the least I have a very threataning sign up now, a notified game warden and two nice patches to hunt over. Only a matter of time before he is prosecuted. If the guy was to get hurt they would own my family's company one day. O well gotta place to bust one when openin day comes. 8)

A lawyer can correct me if I am wrong, but I believe in MS that landowners are protected from liability when the person is a trespasser.
Are we gonna get wet?

short version...there is no absolute landowner immunity of which I am aware. Generally, if you know of the trespassers or know there is a likelihood of people tresspassing you may be liable if you fail to warn them of an extremely dangerous condition that exists on the property. I didn't read the article and I'm not familiar with the case, so I won't go any further except to say.
