MS River question

Postby Jackson » Fri Feb 01, 2002 11:01 pm

Hello everyone, I am new here as far as the posting goes, but I have been reading posts for a couple of years. I have a question that I know a few of you guys can help with.

There is a small pocket (not a river chute) off of the MS river that I hunted with a friend several years ago. At that time this friends hunting club was leasing all of the land around this "pocket" of water. Now, the club no longer exists and I have been dreaming about getting back into this place in the future. The "pocket" is connected to the river by a ditch during low water and is easily accessed during normal water/high water. My question, would this be legal to hunt? There are no posted signs or other warning signs. All hunting would have to be out of a boat b/c the water is more than 6 ft. deep. Also, the couple of times that I hunted it with my club member friend several years ago we had a guy who was not a club member hunt in there and nothing was said about that being taboo. What do yo think? Oh, this place is on the MS side of the river so MS law would apply.
Thanks, Jackson

If the ditch is man-made (ie created by adjacent land owners, Corps of Engineers, etc.), then the "pocket" would not be considered public water, since it would be accessible only by artificial means. But, if the ditch is natural, created by mother nature, and is "navigable" as that term is defined by MS law, then the pocket would be considered public water, upon which you can legally hunt. "Navigable" means able to be navigated by fishing boat, etc (includes a "jon" boat). A little research will be required on your part to determine whether the ditch is man-made or not. I would not recommend you hunting there until you have checked this out.
