Wetland or upland in MS Delta

Postby Bercy » Fri Jan 11, 2019 10:09 am

Can anyone give me a description of what would be considered the difference in wetland and upland in the Mississippi Delta as far as being able to build a cabin on the site? My understanding is that you cannot build in wetlands, but is that elevation/vegetation/other? Thanks.

Its more complicated than that.......
Wetlands having wetland hydrology, wetland vegetation, hydric soils........that would be under the Swamp Buster Act or covered under the Clean Water Act (404 permitting process).
The bigger problem in the delta is the National Flood Insurance Program issue...........building in floodplanes.
That is controlled by each county and you are probably in an Azone or Special Flood Hazard Area where no base flood elevation has been determined (no bfe). Each county has a minimum ordinance free board height requirement meaning you have to build your finished floor above the base flood elevation + free board.
You will need to determine a bfe for your building site and find out the county freeboard requirement.
Its a government thing and its complicated......pm me if you want.

Great post by novacaine. Figuring out if it's a wetland or not is the easy part. Dealing with the county could be the frustrating part. You can request a jurisdictional determination (jd) with the Corps of Engineers in Vicksburg for your campsite. An area that small will not take long at all for a jd. Shoot me a pm and I will put you in touch with who you need to talk to.

http://geology.deq.ms.gov/floodmaps/Viewer/viewer.html

Get on the ms deq website and pull up the flood hazard data and figure out where you are, find the base flood elevation close to your site then add 1.5 ft to 2 ft to the elevation...........I think most counties have gone to at least 18 inch freeboard.

BFE's in south delta may be lower than actual 2011 flood elevations.......
Yazoo River/MS River got to 106.2 ft in May 2011 down south.........and that's high!!!

We don't charge for it, public servants. Or you could pay a consultant to do it and let them send it to us for concurrence. Small sites/projects we will do for you.
