Anyone driving west out of Starkville...........

Postby Smoke68 » Tue Dec 22, 2015 3:17 pm

...........on your way to duck hunt, make sure you stop all the way at the Mathiston HWY 82 stop sign. Like stone cold stop. Even at 2:45 am on a Sunday morning. Even if there is no one awake within the city limits except a police officer parked 50 yards to the north with lights off.

It will cost you $181.

When I was in school at State that place was always a speed trap. You made damn sure you were under the speed limit when it drops from 65 - 45 in about 100 feet, might as well go 5 below once you topped the hill heading into town.

I got a nice 68 in a 65 that cost me $182.

It got bad enough that I started going up 45, and would catch 6 over to 55 and avoid going 82 all together.... Especially considering thats the most boring stretch of highway in this entire country I think.

Did not think that they could run radar on a state highway when their population is only 681 people. Thought they had to have like 15,000 in population to do that?

I don't know about the under 2000 people part, but the Mississippi Court of Appeals has essentially nullified some of that statute. See

http://caselaw.findlaw.com/ms-court-of- ... 17499.html

State Highway 25 in Louisville is a "public street" and not a "highway of this state" according to the COA. Therefore Louisville PD can run radar on Highway 25. It's not a published opinion but it's out there. I know Yazoo City was relying on this opinion to run radar on US Highway 49 (I mean Public Street 49) at one point.

YazooValley - When I read the statute Teul posted I thought about Louisville PD and HWY 25, as I gained experience on that stretch in the early 1990s by the Louisville PD. I had heard about this statute back then. It is interesting to read that COA lists it as a public street and not a highway of the state. I would have thought any reasonable person would call it a highway before a public street. I associate "streets" with the business area of towns and residential areas. Anyway, interesting, and thanks for sharing.

I've gotten that Louisville PD ticket on Hwy 25  . In a hurry to get back in town late on a Sunday night one semester for my last final that Monday when I was in school at State.

Better be careful in the metropolis of Tchula. The man loves to write a "reckless driving" ticket for going above the posted speed. Have encountered him multiple times in the last week. He is collecting his Christmas Bonus.

But he doesn't have the legal right to even have radar equipment. I have been hoping to get pulled over by that guy.
Now don't get me wrong, i don't wish the town to not be able to police the activities of it's citizenry. God knows that town needs police. But him breaking the law, and me breaking the law, constitute two whole different sets of circumstances that I don't find to be fair.

UPDATE:

I have seen the same patrol car camped out at that 4-way stop on 5 of my last 7 trips through Mathiston. All trips between 2-4 am. Exact location of car varies, but it's always watching the stop sign. I'm guessing he changes locations in that hole in order to hunt the wind correctly.
