There is a well defined right away that seperates the property.. It wasn't like they just accidentally walked in on that bird.. You have to walk across a bulldozed line. Any idiot would recognize as a property line. As well as having a past history of problems doesn't help them either. They were in camo putting out their decoy when Mr. Bailey walked up and asked them if they mind if he hunted his bird and then they skeedaddled "RUNOFT"

Just b/c your represent the law doesn't make you above it, nor does it give you a get outta jail free card.

If it had been a one time incident, i think 99% of land owners would of overlooked it no problem; but the fact that it has been a repeating problem, doesn't give them much chance of it being dropped.

Its sad but i think everyone loses in this situation.

I think its funny as hell. PROSECUTE THE GUY FOR TRESSPASS!!! I doesnt matter who it is if they were wrong and had been doing this they deserve it. If it was you or me we would have a ticket!!

If joe ward was from Sunflower, I have met his replacement and he seems to be a very nice fellow.

I don't know this warden we are talking about, BUT, I do know there are 2 sides to every story.

If that's the case they they deserve whatever they got coming. I know the dept of wildlife will not tolerate that! It's hard to get good officers these days and what little I have been around Jimmy he seemed like a good one. Im not saying let him go if he intentionaly did wrong just if it was an honest mistake. Im not familiar with that property, only been there a time or two as a guest. But yes no one should be allowed to abuse his authority and I can assure you the dept will not tolerate that!

West side land battle disagreements going to court

Charges filed in Bolivar County Justice Court against a Cleveland attorney, James Walker, and Mississippi Department of Wildlife, Fisheries and Parks officer Jimmy Russell for trespassing on March 25, have since been rebuked by the two.

On April 1, Walker filed a complaint in Bolivar County Chancery Court, First Judicial District, against David Bailey Sr., the original complainant. According to the complaint, Walker “respectfully requests the Court to rule and issue an Order granting the Plaintiff, James H. Walker, permanent easement by necessity across all real property owned by the Defendant, David M. Bailey Sr…”

On March 25, Bailey signed a general affidavit saying that the two “did willfully and knowingly enter upon the lands of David Bailey Sr. without permission…” He later noted that the duo were “unaccompanied by the owner with the intent to hunt without permission of Mr. Bailey. This incident occurred during Turkey Season.”

Walker claims that the two own landlocked sections of land at Donaldson Point, a hunting club located near Gunnison, and that he has tried in the past to come to an agreement with Bailey about using his land to pass through.

“Several wood roads now exist on real property of Defendant, David M. Bailey Sr., that would allow ingress and egress to real property of Plaintiff, James H. Walker,” the complaint stated. Ingress and egress are the legal terms for entering and leaving owned property.

“The Defendant, David M. Bailey Sr., steadfastly refuses to allow the Plaintiff, James H. Walker, to reach his property owned next to or adjoining properties...,” Walker continued in the affidavit. “The Plaintiff has made a good faith effort to settle all matters stated in this Complaint…leaving the Plaintiff with n other alternative but to request relief from this Court.

“The most direct route from the old river due east to the property of the Plaintiff, James H. Walker, is through the real property of the Defendant…”

In the complaint, Walker also alleges that Bailey harvested timber off of his property. Walker is asking the court for easement through Bailey’s property and a judgment for damages rendered for the harvesting of the timber.

Russell and Walker will face trespassing charges in court at 9 a.m. April 29, in the Bolivar County Courthouse in Rosedale.

well he's a good guy and one of my best friends. He's going to be a good and tough game warden on the outlaws around sunflower county. I have been keeping up with the story through the cleveland current. Bailey has stirred a pot and it's about to get serious.

If the plaintiff in the civil action has land that it land locked, he will win that case. The court will establish an easement, usually the most direct route, and that will be the end of it. Sounds like the land owner that surrounds the land locked property has and is being a hard booty. He should have thunk that one through prior to filing trespassing charges.

Been there done that with property I managed at a former employer. I've messed with everything from land locked property to houses built on the wrong section of property to half the house being on the correct property and the other half being on the neighbors.

That was the area of my job I liked the most. If everything had been done right on the front end by the loan officer, I'd not have to fool with it. That never happened though.

read the paper above. bailey cut timber across his line on walker. Walker will seek damages associated to this timber being cut that belonged to him.
