Just out of curiosity. Is the dog owner's homeowner's insurance providing him with a defense? I had a case a year or two ago where a bulldog bit a kid in the face and effed him up pretty bad. (plastic surgery, etc.) Problem was the dog owner didn't have homeowner's insurance and he was in bankruptcy. We ended up never filing suit because we didn't want to go through all that trouble to obtain a worthless judgment. I found out while researching my case that some homeowners policies explicitly exclude coverage on pitbulls. If this guy claims his dog was not a pit, it could end up working to your advantage, but you still have to prove that this dog had bit or attacked before. (first bite rule)

I love dogs, but even if that one in the tutu stepped onto my proporty it's DEAD!
