I dont believe you can do that ...the deer are not yours they are property of the state untill you kill it then u can lay claim to the deer....hard pressed for suein someone over something you dont own.......

Yes, it's happening a lot now. You can be sued in Civil court......b/c if you have a deer management program your land can be considered worth more. Just like going to Texas hunting and such.......they value a hunt at a base price plus a price per inch. You figure the value of what it cost you to grow those deer and the judge will place a penalty on the individual for an amount. Some guys just got caught this week shooting one over on the levee and one of the landowners is an attorney and will be taking them to civil court. The next thing you know......a deer that you didn't get to keep cost you $25K.
