Joel, I couldn't agree with you more! It was never this commissioners intent to make a refuge out of navigable waters on 6 Mile. The private property being gifted to the state has a requirement of being a refuge and that should not be a problem as it was private property to begin with and not open to the public.

And I agree. But, the fact that Delbert had the DEQ executive director, Gary Rikard (gary_rikard@deq.state.ms.us), redefine the banks from the 2001 case that involved him (CREELY v. HOSEMANN, NO. 2003-CA-02353-SCT), changes where those navigable waters are set. If you talk with the Gary I think you will find him a little remorseful that he didn’t take that task to the DEQ commission rather than do that himself.
