Still, a duck is a duck. If I got removed from a club or any group for simply making a lawful and morally appropriate response to a situation so blatantly unethical, I'd tend to wonder how well this theoretical relationship would last anyways.

Man that would make me furious. Think I would have to do something, not sure what but something. Moral of the story here is when buying a duck hole, find a lawyer that does not hunt, doesn't know what a duck looks like, or can even spell duck.

Well, the lawyer might not even be a duck hunter....he might just be buying it out from under the guy, and looking to turn a quick buck, by re-selling it....either way, he's a slime ball, and he needs to be reported to the bar assn., or a hoe handle up side his haid.

Your story reminds me of a similar event my Dad shared with me a few years before he passed. He had just gotten out of the Navy and he and my Mom were looking for a home. They happened upon a great deal for a small house on Moon Lake in Coahoma Co. that had just gone on the market. This would have been about 50 years ago. My Dad goes to a local banker and describes what he is wanting to do. The banker shows interest in setting up a loan for my Dad but said he needed to go inspect the home. Contacts my father later and states that the bank can't loan against that property because it is considered recreational property which they do not finance. A week later, the banker had a contract on it. My Dad's redneck revenge... Every time he drove by that home which was situated right along the side of the small public road, and since the banker used it for recreational purposes, Dad would take a window out with a brick. He said it did it several times over the course of a few years.

I contacted the Mississippi Bar Association on Monday. I faxed them the title opinion and proof of payment for legal services.They contacted me back today and indicated they are going to proceed with an investigation. They asked me to swear out a formal complaint. I completed out an affidavet this morning. I wont share any further details until the bar renders an opinion, but you'll soon be able to identify the attorny by searching for Bolivar lawyers with past and pending ethics investigations. I hate to get involved, I just wish I was closing on that 200 acre hardwood tract with levees and and pump in place.

If you had written contract with the land owner, i strongly recommend hiring a lawyer and filing a lis pindens in the land records to give other purchasers notice of your potential claim of an equitable lien on the property. a lis pindens usually deters others from purchasing, and banks usually wont finance purchases with outstanding lis pindens.JDgator wrote:Guys:
