Re: Pass Taylor arrested
People still don't understand that people with an interest in profiting from hunting migratory birds are always going to be put under a bigger microscope from all levels of enforcement. If you're going to play the hunting for profit game....you better play by all the rules.
Re: Pass Taylor arrested
And according to 18 USC 2(a) ["Whoever commits an offense against the United States or aids, abets, counsels, commands, induces or procures its commission, is punishable as a principal."], you can get 6 months in that same federal pen and fined $15,010 if you take Joe Bob to your property and he kills 7 ducks.YazooValley wrote:You can get a year in the federal pen for not filling out a pink card. Did not know that.

it was a joke aimed at an obvious assumption anybody would have made given this crazy story...I don't have any ill-will towards your line of work...and yes, I'd crack those same jokes or jokingly asked how to get on that undercover team in person...I'm not being condescending AT ALL.Wingman wrote:camlock wrote:wonder how much those undercover agents enjoyed their baited, over the limit, and "exclusive"hunts on refuge propertyI'm sure they cringed at every bird they shot.

Or is the internet your preferred methods for being a condescending a-hole? Just wondering.....
OH...and I do still think it borders along entrapment, I'd tell you that in person too...and I'm not trying to sound any way by saying any of that...but I'm not doing anything like this guy, I respect and follow the law and it's officers (except for my current inspection sticker situation, here nor there) so I don't look over my shoulder for any condemnation from a superior authority cause I make a joke on the internet. Nor would I cower and not be myself in person when talking about such a thing...I got not reason as a law abiding citizen to not by myself or not say what I feel in a free society...

Re: Pass Taylor arrested
Do the people throwing around the word entrapment actually understand the elements involved? It's a little more in depth than just "setting someone up".
http://www.justice.gov/usao/eousa/foia_ ... m00645.htm
Entrapment is a complete defense to a criminal charge, on the theory that "Government agents may not originate a criminal design, implant in an innocent person's mind the disposition to commit a criminal act, and then induce commission of the crime so that the Government may prosecute." Jacobson v. United States, 503 U.S. 540, 548 (1992). A valid entrapment defense has two related elements: (1) government inducement of the crime, and (2) the defendant's lack of predisposition to engage in the criminal conduct. Mathews v. United States, 485 U.S. 58, 63 (1988). Of the two elements, predisposition is by far the more important.
Inducement is the threshold issue in the entrapment defense. Mere solicitation to commit a crime is not inducement. Sorrells v. United States, 287 U.S. 435, 451 (1932). Nor does the government's use of artifice, stratagem, pretense, or deceit establish inducement. Id. at 441. Rather, inducement requires a showing of at least persuasion or mild coercion, United States v. Nations, 764 F.2d 1073, 1080 (5th Cir. 1985); pleas based on need, sympathy, or friendship, ibid.; or extraordinary promises of the sort "that would blind the ordinary person to his legal duties," United States v. Evans, 924 F.2d 714, 717 (7th Cir. 1991). See also United States v. Kelly, 748 F.2d 691, 698 (D.C. Cir. 1984) (inducement shown only if government's behavior was such that "a law-abiding citizen's will to obey the law could have been overborne"); United States v. Johnson, 872 F.2d 612, 620 (5th Cir. 1989) (inducement shown if government created "a substantial risk that an offense would be committed by a person other than one ready to commit it").
Even if inducement has been shown, a finding of predisposition is fatal to an entrapment defense. The predisposition inquiry focuses upon whether the defendant "was an unwary innocent or, instead, an unwary criminal who readily availed himself of the opportunity to perpetrate the crime." Mathews, 485 U.S. at 63. Thus, predisposition should not be confused with intent or mens rea: a person may have the requisite intent to commit the crime, yet be entrapped. Also, predisposition may exist even in the absence of prior criminal involvement: "the ready commission of the criminal act," such as where a defendant promptly accepts an undercover agent's offer of an opportunity to buy or sell drugs, may itself establish predisposition. Jacobson, 503 U.S. at 550.

I said borders on entrapment, lot of things in society toe legal lines...it's why we have lawyers...but again, I was joking...I'm personally not gonna be in the situation to have to personally deal with any of that. So my apologies for cracking wise on the internet if anybody else has been offended...not my intentionchevy01234 wrote:Do the people throwing around the word entrapment actually understand the elements involved? Re: Pass Taylor arrested
Well here is a MAJOR problem with large amount of the charges listed......
For more than half of both years this investigation was ongoing, there were no pink cards in the box to fill out. SO how in the world can you write a legitimate citation for a supposed broken regulation when the regulation cannot be followed because of the lack of administrative duties preformed by the YNWR personnel. They know full well there were no cards nad had to reorder mid season. I spoke to them personally to make sure we were covered in case we were checked and didnt have one filled out.

Re: Pass Taylor arrested
The government went after Pass. He was their target. The charges (except for over the limit) look like a whole bunch of nitpicking BS to me. Dont give me any crap about the baited field. If you have ever watched a federal game warden evaluate if a dove field is baited you would realize that to them....every field is baited.
The Federal "special agent" game wardens are looking for any way possible to write hunters tickets. Jack Booted Thugs.
The state game wardens I have had encounters with have always been reasonable men.

Re: Pass Taylor arrested
Here are my thoughts for what they are worth:
1. The prevailing attitude on this site is that if you disagree in any way with the tactics, procedures, etc of the federal government and its agents involved with law enforcement you are a de facto lawbreaker.
2. We have a lot of armchair lawyers on this board who have never passed or taken the bar, let alone graduated law school.
Give me more time and I will add to this list. In the meantime I am going scouting for ducks.

Re: Pass Taylor arrested
I met him once and talked for about 2 hours. I could garner his "disdain" for the Fed. Gov. I guess the feeling was mutual and they caught up to him. Heard stories of Pass outlawing but did not know first hand so won't comment. Just saying this "fued" goes way deeper between the parties involved than we know about, so let it play out in the real courts. Kangaroo court like this site doesn't count!

Re: Pass Taylor arrested
Tactics, morals and this Pass guy's coger-ness aside, some people including myself just think that taxpayer resources could be better allocated. It took 2 years and multiple federal agents to build a case against this dude, meanwhile every mid to large city in the south is running rampant with violent crime offenders and entitlement abusers. Spare me the "the agents working on migratory bird crimes aren't responsible for the other stuff" arguments. I respect game wardens, other law enforcement officers and the laws they uphold, but we've got to get our priorities in order to move our society in the right direction.

it's just a dog-goned, golly gee willeckers pflucking shame a man of his character has the hammer dropped on his sorry azzz
and, what's even worse, worse by light years i say, aye, tippy tippy day-day, is that anyone, ANYONE YOU HEAR ME henceforth and hithertofore, on this board would be out, gnash teefs, and pull the few hairs you have left on your head out over such an atrocity, A SIN IN THE EYES OF GOD, as some law enforcement officer using every means possible to dishonor, dis-integritize, and disenfranchise one who has obviously gone to such limits, such heights, such personal strife as to uphold, holdfast and lead by example to us ALL in the name of CONSERVATION, FAIR CHASE, and just outright human decency.
i mean, you guys act like the old basterdous pissant used his advantage to the pull in dolla bills........dolla dolla bills, when the rest of you poor saps were freezing your azzes off at a boat ramp surrounded by knumbskulls who prefer to ride around that dump in LOUD surface drives.
you know what? as an act of solidarity, an olive leaf if you will, i'd like to lead us in a word of prayer.
will the congregation bow their heads?
Dear Lord, we as an intelligent peoples are willing to do what's necessary to "right the direction of our society" and we CHOOSE Lord to have the law enforcement officers look the other way when the breaking of a law doesn't merit what our brains tells us is important......like Lord, let's just say - for examples sake - driving 80 in a 65. I mean, Lord, that's pretty mundane and really the LEO is showing his/her arrogance and stupidity by even stopping me. Remember, that's just an example Lord..........and, please remember Pass, Lord. He was such a "giving soul" Lord. I mean, giving that steel (or lead) to all those ducks all those times when i was sitting in some garhole.......Lord, it's Pass, Lord........Pass, he's old, real old.......can't you give him a, well, Pass? He probably doesn't know how to read Lord, he probably couldn't read all those rules and regs regarding Duck season...........I mean, 6, is a lot of numbers to count too.........there's like 5 before that, unless you count "0" which is what most of these girls on this dump tend to bring home, whether at a bar or hunting, though i digress.
P.s.....Lord, you know that whole scenario I talked about regarding someone driving 80 in a 65? Well, I'd like to pray for every board member here with a child (myself included) that if that 80 MPH mundane violator of the law is carrying my child (or anyone else's for that matter) away to use every orifice on their little bodies as a target................................well, a little headsup would be nice. that way, it keeps me (or anyone else that thinks "certain laws need to be looked past in order to get society on track" keeps our children whole.
**BUT BUT BUT, not all the time Lord........Just when I need the law and LEO's to work in my favor...............otherwise, i need us to focus on righting this society by disregarding it's laws. but BUT BUT, just a few laws Lord......you know, the stupid ones. Lord, you got a sheet with those laws - i know someone up there does Lord, don't hide it - and i'll just circle the ones to disregard and WHEN i want you to disregard them. thanks man, you're the bestest
thanks Lord, and thanks msducks for allowing me a place to hang with such a fine bunch of conservationists.
