Yall teach me about ccw/criminal cw

The way I understand the law is that I can carry my guns with me while on my property anyway I want to.

2. In my car any way I want to.

3.But if Im out of my vehicle in town I cant have a 380 in my pocket.

4. If im out fishing, or hiking or what ever on pubic land or waterways, I cant have the 380 in my pocket. But I could have a 22 in a holster on my belt.

I do not have a ccw.

Yall set me straight please.

You can carry it on your property and in your car.. But you can't carry outside your car without a permit, depends on what kind of public land your talking about. Check out handgunlaw.us

Have to have concealed carry permit to have it in vehicle. You can carry whatever you want on your property.

Castle Law makes your car an extension of your home no need for a permit to have it in your car

Wrong..In Mississippi as long as you are over 18 years old you can have a firearm concealed or in plain view in your vehicle without a permit.

I understand this to be incorrect according to an opinion issued by the Attorney General on June14th 2012.

In the document referenced there, note the "nothing in this section shall be construed to allow the open and unconcealed carrying of any stun gun or deadly weapon..."

"It shall not be a violation of this section for any person to carry a firearm or deadly weapon concealed in whole or in part if the possessor of the weapon is then engaged in a legitimate weapon-related sports activity or is going to or returning from such activity. For purposes of this subsection, “legitimate weapon-related sports activity” means hunting, fishing, target shooting or any other legal sports activity which normally involves the use of a firearm or other weapon."


This is of course my personal, non-professional or non-legal opinion that doesn't really mean jack but I believe Hood was referring to people with a firearms permit open carrying under the permit. Per the section I quoted above, Lodi should be covered if he's on his way home from the farm or whatever and has to stop at the store for milk and still has a pistol on his hip or he is participating in a "legitimate weapon-related sports activity"

With that being said, I think open carry is a terrible idea personally. I don't want to draw attention to the fact I am armed. It's not worth the hassle of upsetting the sheeple then having to explain or defend your actions to the SEVERAL officers that will respond to a "man with a gun" call (which trust me, SEVERAL will respond per SOP). You will be detained, disarmed, and questioned. Unfortunately Law Enforcement don't have a dossier on every "good guy" in the county or city so you will be questioned until determined you have no ill intentions. I know some people get off on those sorts of confrontations but it is an unnecessary hassle as far as i'm concerned. Also in my very humble opinion, I believe it makes you an immediate target if you happen to be in the wrong place at the wrong time. I believe it could also escalate a situation that otherwise may not have escalated but that is another topic all together.

Kind of getting off track but there are several contradictions among the laws on the books that need to be settled in court. Which laws take precedence if you are technically right under one law and "wrong" under another?

I had a lawyer tell me that you can carry it in your car but can't be concealed in any way. So technically if it laying on your console and you can't see the bottom side of the gun then it can be considered concealed if the officer want to pursue it. I have no idea if this is true just what I was told.

He is wrong. Plain and simple.

§ 97-37-1. Deadly weapons; carrying while concealed; use or attempt to use; penalties.

2.
It shall not be a violation of this section for any person over the age of eighteen(18) years to carry a firearm or deadly weapon concealed in whole or in part within the confines of his own home or his place of business, or any real property associated with his home or business or within any motor vehicle.

I will.

Im perfectly legal to go fishing with a 410 for snakes or cans or whatever, arent you perfectly legal to have a 22 pistola or even a 44 mag strapped on your hip for the same purpose?

What about the 380 in your pocket while fishing or boat riding or protection on isolated boat ramps? Or just whatever?

I have never really thought about this because growing up in MS we aalways had guns with us.


I posted this and walked away, only to come back and see that it never posted because someone posted before me. SO, now reading these other posts looks like I am legal to have the 380 in my pocket when im out fishing or persuing sporting related activities. I dont carry a gun in a holster, I dont even have one, but If thats the only way I can legally carry a pistola when I am at these boat ramps and other isolated places thats what Ill do. I havent really ever worried about the legality I have always just had a gun of some sort. The deal changer is that I have almost always had another friend with me or a group of friends. Now I find myself in these places at daylight and dark and I now have my 7 y/o son with me and will soon have baby girl with me at times.
