Agreed. I thought it was interesting that they used undercover officers that shot over the limit themselves because Foiles "told them to." This investigation has been going on for a great amount of time, and they (more than likely knew what he was doing) for that time. At what point do they say enough is enough to bring the thunder? How many times over the limit or what not does it take? How many times does an over the limit duck massacre have to take place before he is called out on it. Why not get him the first time and teach the dude a lesson?

Kind of hard to say. If he shot 2 over the limit and they popped him right off the bat, then a number of fans would be saying "well, he just didn't count them correctly" or something similar.
