Limit vs. Possesion

Okay, I know that this dead horse doesn't need beating again, but I got a question. If I go and shoot my 2 wood duck limit, walk back to my vehicle, drive to a different spot, walk somewhere else then shoot 2 more am I legal? I was thinking about doing that this morning, but thought better of the idea. I know that possesion is twice your limit (I know it gets alot more complicated). Sure would appreciate a clarification on this. I would love to be able to take 4 woodies home in one day, but I dang sure don't want to be illegal.

Legally you can't do that. If you kill 6 wood ducks in three days and haven't consumed two of them them, you are considered over your possession limit by law. You can't legally shoot two limits in one day and call it a possession eighter. Once you shoot your limit, you are done for the day. If the feds raid your freezer and you have more than your possession in it, which would be 5+ woodies, they can ticket you for over possession.

Thanks Don, I kinda' figured it would be illegal, but still had to ask. I know the whole deal about the feds raiding your freezer and such, but you and me and everyone else knows that's never gonna' happen. Not enough man power and not enough funding. Plus the feds have bigger fish to fry than to go checking what people have in their freezers.

However, all us folks down here know if the BMR/DWG&F thought you might have an illegal REDFISH in there, they would overlook Charles Manson the Duck Killer's freezer and step over a million wood duck carcasses to come nab ya for dat fish...... :roll:

True, but the guys do have a job to do. The funny thing is that no one cared about redfish until Paul Prudhomme started the blackened redfish frenzy in the 80's. The feds went out to try and get some stock numbers because they realized too late that the stocks where taking an ass whippin'. Well, the feds ended up netting a pile of fish to tag--oops, forgot about all those excited fish dropping the disolved O2. :oops: Bad for NMFS, worse for the fish. From what I have been told, you could see dead redfish for miles. Because of this little SNAFU the feds are VERY protective of these fish. Of course the managment issues go alot deeper than that, but you get the tip of the ice berge.

So GC are you telling me that I can go kill a pile of woodies and you would represent me before Judge JB? :wink: :lol:

Maybe we could get Paul Prudhomme to work on a recipe that makes snow geese edible. That could be the beginning of the end...

This is America....For any law enforcement officer to enter your dwelling or search any closed area of your vehicle not visible from the outside, he or she must have probable cause to do so (or your permission) OR a search warrant issued by a court ...

Probable cause would be some reasonable belief that a crime had been committed or that the fruits of your crime were hidden within...

The simple fact that you are a duck hunter, that you have on camo, that you have calls on your lanyard, that you admit you have been hunting are simply not enough to create probable cause for a search....Nor is refusal to give permission to allow a search...

I dont want to encourage anyone to violate game laws...but come on...this is America...not China....The Man cant just walk in your house or your duck camp and look in your freezer...or in the cooler in your truck for that matter,,,,,,,without probable cause or a search warrant !! (or your permission dummy !!)

Ive met a number of law enforcement personnel...game and fish included, who attempt to bully or intimidate persons into giving permission with threats of more serious prosecution if you dont co-operate, etc.....

If you are legal, it may be no big deal....but you dont have to let them look in your freezer unless you want to !!

who cares???? You have to be able to kill a limit before you can be over the limit!!! Oh yeah, a game warden is the only branch of law enforcement that does NOT have to have any kind of search warrant whatsoever to search your vehicle, boat, freezer, duck blind, house, or anything else he decides to search.

Sorry to argue....but I think you are wrong on that one...

The Constitution of the United States guarantees you that right...

Game Warden or any law enforcement officer MUST have probable cause to search your vehicle or your house.....

The basis for my opinion.....3 yrs law school....14 years in private practice

may have been told that all my "growing up" years to keep me on the straight and narrow...kinda like you were told there was a Santa Clause until you got to be about 7 or 8 years old...one of them deals. I have always looked at it that way and well, I still do...better to err on the side of caution...if you know what I mean.

I would not worry about the freezer police. Just wrap your ducks in freezer paper and dip then in liquid wax to create a sniff proof doggie barrier and you will fool the freezer police because they let the dogs do all the work.

However shooting over 2 is double dipping, triple dipping, and your going to get your butt caught dipping,and there isn't a wax yet to cover that up. Besides that, it's wrong. However there is always the fake gas tank compartment trick, the hollow goose decoy trick, the bricks in an old decoy bag trick, and some tricks I'm not at liberty to say here.
All I can tell you is tricks can be magical but when they dont work it isn't funny. The game warden doesn't like the duck in the hat trick.

I wouldn't do something wrong when it comes to this, thats why I have 65 wax coated ducks in the freezer. I gave them to grandma, grandpa, cousin ernie, cousin vern, all their half cousins and two for my inbred cousins. tthey are not mine, I'm just keeping them for all them nice folks.
