Legal Limit for alcohol

I was in a fender bender the other day and the guy who hit us was drunk. He "scored" a .25 on the breathalizer. What is the legal limit? .08? If so he was hammered. Does anyone no what the citiation codes means on the accident report? I am curious what he was cited for.

.00000 for under 21 and for over 21 its .08 Wingman or some other LEO will have to chime in on the codes

Post the codes. They are just MS State Statutes. For example (63-15-4) is no insurance.

@.25 he was close to dead, much less hammered.

Had a guy come into the drunk tank one night reg 3.6 deputy said he should have been pronounced legally dead........had to move the ole Beanland 8 into another cell before we killed him cause he kept pissing all over the place........

That's the DUI section of the Miss. Code. And for under 21, it's > .02

I had to do an accident report on a guy that fell nearly 20 feet from a ladder stand one time. When he got to the hospital (about an hour after his wife found him at the bottom of the ladder) he was .26 I think. No telling what he registered while in the stand. The beer cans at the base of the tree told the story. He was basically uninjured in the fall. Anybody sober would've probably been paralyzed from the neck down.

Thank the good lord no one was hurt in the wreck b/c my wife and little girl were with me when he hit us. I am glad that little fender bender got him off the road before he hurt or killed someone.

when did it change? when I was under age it was zero tolerance or so I thought

If you have comercial drivers license it is .02 no matter what you drive or age.

For your reference:

M.C.A. SEC. 63-11-30. Operation of vehicle while under influence of intoxicating liquor, drugs or controlled substances, or other substances impairing ability to operate vehicle or with blood alcohol concentrations above specified levels; penalties generally; granting of hardship driving privileges; penalties for violations resulting in death, disfigurement, etc., of another; penalties for multiple offenses; concurrent running of suspensions.

(1) It is unlawful for any person to drive or otherwise operate a vehicle within this state who (a) is under the influence of intoxicating liquor; (b) is under the influence of any other substance which has impaired such person's ability to operate a motor vehicle; (c) has an alcohol concentration of eight one-hundredths percent (.08%) or more for persons who are above the legal age to purchase alcoholic beverages under state law, or two one-hundredths percent (.02%) or more for persons who are below the legal age to purchase alcoholic beverages under state law, in the person's blood based upon grams of alcohol per one hundred (100) milliliters of blood or grams of alcohol per two hundred ten (210) liters of breath as shown by a chemical analysis of such person's breath, blood or urine administered as authorized by this chapter; (d) is under the influence of any drug or controlled substance, the possession of which is unlawful under the Mississippi Controlled Substances Law; or (e) has an alcohol concentration of four one-hundredths percent (.04%) or more in the person's blood, based upon grams of alcohol per one hundred (100) milliliters of blood or grams of alcohol per two hundred ten (210) liters of breath as shown by a chemical analysis of such person's blood, breath or urine, administered as authorized by this chapter for persons operating a commercial motor vehicle.
