my wife has accused me of cruel and inhumane treatment and adulty and now says i threatened to kill her.
I have never done anyof these things.

she is saying that you threatened to kill her so that the habitual cruel and inhuman treatment will stick. If you never did that, fight it, because she has a high burden of proof there. and for that to stick, she has to show some physical or mental injury, so be ready for her to say that she is scared for her life to be around you.

as for the adultery, if you did it and she knows you did it, you might be in trouble. If you didn't do it, or if you did it and she doesnt know about it, you are probably ok. Adultery is the only grounds for divorce that has a presumption of innoncence built in to it, so she will have to really prove you did it. It sounds like to me that she has lawyered up and if I were you, I would do that same.

cruel and inhumane treatment is the least they can possibly accuse you of in a fault divorce.

I have been through this recently, and it was not HER that necessarily put those words down on paper. Her attorney is the one making all these fancy words up and putting them in HER mouth. I'm not taking up for her, but i know what i know.

They said that my dad was cruel and inhumane......he never raised his voice in 30 years. thats just legal garbage. She has to say something in order for her to collect some type of settlement. that is her leverage...or the attorney's leverage.

I guess what i am saying bottomline is.....she may not be the one making up these statements. So when you get a letter from her lawyer, about 3% of it is what she actually may have said.

then you should be set. she has to have proof of all the stuff she is accusing you of. Now if you want to get dirty, dont grant her a divorce (she has to "earn" a divorce). That will piss her off royally. plus that sets you up for looking good when things really go south. I dont know the whole story, but if she is initiating all this, it sounds a little fishy.

Keep in mind that these allegations are simply alleged grounds for the divorce. IF you are agreeable to get divorced, then it is likely that the case could proceed on the ground of irreconciliable differences, without getting into all of that drama . And since your wife has now crossed that threshold of accusing you of such horrible things --- lying, according to what you say -- then, it might be best to just agree to give her what she wants --- a divorce.

Technically, according to the law, any alleged "fault" is just grounds to get divorced, and plays no part in the child custody, alimony or property distribution issues, which are decided according to separate and different factors. Your atty should be able to advise you on these aspects of the matter.

Burden Of Proof is on her. If the cops have never filed a report of abuse and she has no tapes of you threatening to kill her she has SQUAT!!! I am sure her attorney will tell her different as to get her $$$$$$ and that is why you will have to spend ample $$$$$ to prove you did nothing of the sort. Allegations are just that.
