Night Vision goggles are "light amplifying devices" that is how you can be charged with headlighting.

If you are riding around at night with N/V goggles and a gun what else is theree to prove.

Legislative Overkill! Most people will think it is good; and it is an election year.

On the other hand. Everybody knows why such a law is necessary and the kinks will be worked out in the legislative process. There are so many laws now that you break one by adhering to another. Legislation ain't solved this and MANY other problems. People doing the right thang is the only answer.

Sorry folks, but we need laws. All the laws in the world won't overcome STUPID.

Any person who hunts or takes or kills any deer at night by headlighting, by any lighting device or light amplifying device shall, upon conviction thereof, be guilty of a Class I violation and shall be punished as provided in Section 49-7-141.


Pulling over on the side of the road and using NVG's while a weapon is in the truck is all it takes. If you must use NVG's, or any other lighting device, leave the guns at home.

what about people that use NVG to get back and forth to the stand so they don't spook deer.

I hope it doesn't pass. I sure do like looking at the ruttin bucks on the levee up by eagle lake with my light. Hell... every other truck riding up and down that levee from the middle of December to the end of January usually has a light and are checking out the deer herd.

I'm like a Buck...I dont like someone holding the light on Me while I try and make little deers.

I hope it does pass, wonder how many of those trucks are PETA trucks and not Shinners?

I agree B-80. We have shined that area for as long as I can remember. 99% or the people out there are doing it for pure enjoyment. It is amazing some of the deer you can see at night. I personally think it is overkill. They would be punishing all of us that are legal to try and stop the 1% that are not.

This law would not stop a poacher from shooting a deer on your land at night. It MIGHT make it a little more difficult, but would not stop it.

Just my 2 cents.

What you use NVG and you are on your way to go hunting and are parked on the side of the road getting ready and a GW stops and gives you a ticket.
Not that I really care because I can't afford any good NVG. I don't hardly do any spotlighting anymore. It kind of pisses me off to see all those big deer at night then never see them during the day.

I guess basically what I'm saying is a GW is setting up trying to catch people spotlighting and is looking for people shining a field or road or whatever, I understand how that guy gets caught by shining a light that can been seen a long way and GW comes up behind them and pulls them over gives them a ticket.... I understand that scenario. What I can't see happening is GW setting up in same field trying to catch someone spotlighting and a truck drives by never shines a light and using NVG's how in the heck is that GW gonna be able to see someone inside that truck using NVG from a couple hundred yards away and be able to prove it even if he had the truck on video in court. A good attorney will rip that apart. I understand the law. I just see what is gonna start to happen more than it is now if this law passes. And with a department underpaid and understaff. It's gonna make their job a lot harder than it is now.

I think their job is already too hard for what they are paid.
It is my opinion that they do what they can do and the rest just happens.

Relax folks.

The harassment part will apply to folks shining spotlights from public road or using vehicle lights in an abnormal manner to shine deer.

Landowners or folks with permission on private land can still shine for deer.
