16 year old and a new red sports car

Postby Seymore » Mon Dec 18, 2006 8:20 pm

I got hit last week by a 16 year old who had his license less than a month. Had his girlfriend and her friend in the car with him and he totaled the sports car, the SUV he hit, and then did about $4,000.00 to $5,000.00 worth to my truck.

I called his insurance last Thursday and got a cocky minority claims adjuster who tells me, "theyz haz them a witness who be saying it's not be their insured's fault. I needs to be talking to the drivers of the SUv whose knocked their's insured into me".

Ticked me off bad 'cause I had the police report with a witness statement saying the boy was at fault.

Get a call today from the adjuster's supervisor and it turns out their "witness" was the boy's 16 year old girl friend who was trying to save his butt. Once they got the police report, they got real nice real quick.

The rental they got me is this little red chevy clown car. I told the rental place I wanted a trailer hitch on it to haul my 4 wheeler. He was not amused.

Serves mommy and daddy right for buying a kid a new sports car. Nobody was hurt and hopefully he learned something.

By law they will have to allow you to have a rental of same basic type. Meaning same number of seatbelts and truck or car or suv. Also you should ask for a loss of value claim due to you now own a wrecked truck. They should pay you 2 to 12 % of your truck worth as a loss of value. Also if your insurance wont cover your rental the insurance company at fault will have to pay it for you. It was not your fault so dont let them shaft you.
My 2 cents.

Jetduck is right on. You got to set the tone with these fellows are they will give you the short end of the stick. Don't pick up the truck until you are 100% satisfied with the work.

I have a friend that used to have an old 72 chevy truck that got hit and the ppl's Ins Co. said it was totaled and wanted to give him 600.00 for it, so he went and filed charges for destruction of private property, the guy got arrested and the next day the Ins Co. settled with him for 3200.00.

The driver's side door was jammed and I couldn't get out. I just sat there until the police showed up and he asked me to crawl out the passenger side. I told him I had rods and screws holding my spine together and really prefer not to. Next thing I know he's called the fire department and they are about to cut the durn roof off with the jaws of life. I told him to just give me a minute and I'd wiggle out, but, don't cut my dang roof off.

When I got the police report the next morning, it of course had names and phone numbers. I did what I thought was the right thing and called all the parties just to be sure everyone was okay Didn't discuss the accident as that wasn't the place or time. The boy's mother and father were actually very concerned about that very issue. I'm pretty sure everything is fine and assured them they didn't need to worry. I guess if was like that I could have taken the ambulance ride and gone for the whole enchilata. The "one call, that's all route". Everybody was okay and that's the main thing.

Back in August of this year, I was hit by a mini-van full of Mexican's that went through a stop sign. I stopped and expected the same, but the girl that was driving looked at me and started driving off. I said to myself, he** naw, this is not happening, so I spun a U'ey and went after her and once she realized I was coming after her, she pulled over. I was on the phone with the police as I went after her so by the time we got stopped, I hoped they would be close. I counted 9 climb out of the van, and the driver was on the cell phone gibbering something and before the police even got there, a SUV showed up with another Mexican driving and all but the driver hopped in and sped off, I was amazed that all this had taken place in the matter of a minute or two. The lady who was driving was being sold out for the better of the others I guess. Anyway, the police got there and she didn't speak english so she had to have a interperture. She didn't have a Green card, Work card, DL, or Insurance. Nothing but what I guess was a cell #. I was pissed but luckly, she was in a Work (Company) Vehicle, and they were very cooperative of getting me pretty much what ever I need while my truck was being fixed after I called the companies Insurance Co and let them know that they were letting an Illegal Imigrant drive with out personal Insurance, DL. I guess the others in the vehicle were illegal as well. I later found out that the company did get fined by there insurance co. but the girl who hit me is still working, nothing at all happend to her. How does this happen??????

I have a better one, a 15 year old girl hit my wife that only had her learners permit. Your supposed to have a licensed driver in the car which she did, the only problem it was her best friend and she was 16. Your supposed to have atleast an 18 year old. A young cop was going along with the teenagers story at first then a witness showed up and confirmed my wifes story. My wife was sitting still when the girl cut across 4 lanes of traffic, she scrapped her car along the front of my wifes jeep. Then the fun started, the parents wanted us not to file insurance and try to work it out.

I think it has totaled mine. I have a 2003 base model S 10. We are talking point A to point B transportation here with no frills. My wife drives the nice ride. Book value is about what I think the damage is, but, I'm not an adjuster or body shop guy. Waiting on them to get in touch with me.

If they wait to long, I'm going to throw three dozen dekes on top of the little box car they gave me, put my dog in the back, and hook my 4 wheeler up. :P

Please dear god, take a picture with the dog hanging out the window and the 4 wheelie rope tied to the bumper. that would be priceless.

PS, yet another reason I won't buy a rental car.
