Statement re Powe situation from UM Chancellor

Re: Jerrell Powe Admission/Eligibility
Given the high level of visibility of the Jerrell Powe application /
eligibility discussion, I thought it would be helpful to provide the
following:
As background information, please remember that the IHL Board adopted as
one of the admissions criteria for all eight universities the NCAA
standard for eligibility. After careful review by our Academic
Credentials Review Committee, the committee was uncertain whether Mr. Powe
met the NCAA eligibility standards and, therefore, the IHL admissions
standards. The NCAA Clearing House had questions about Mr. Powe's
credentials and asked us to send additional information, which we did.
Following a review of that information, the NCAA staff determined Mr. Powe
was not eligible. The University and Mr. Powe have since requested a
review of that decision by the NCAA's external review group. We are
presently gathering additional information for the NCAA staff and the
external review group to consider.
Mr. Powe filed suit for injunctive relief which was granted by the
Chancery Court of Lafayette County, ordering his admission to the
University. Subsequently, Mr. Powe, the NCAA, and the University agreed
to allow Mr. Powe to temporarily enter as a parttime student, receiving no
financial aid from the University, and not participating in football. His
athletics status is currently that of a prospective student athlete. The
NCAA will review its decision between September 9 and 16. If the NCAA
denial is reversed, Mr. Powe will be allowed to enroll fulltime and
participate in football.
Under the Americans with Disabilities Act, we are required to provide
assistance to students with disabilities, including learning disabilities.
The University has complied and will continue to comply with that federal
legislation, which is applicable to all students.
If the NCAA affirms its decision and denies approval of Mr. Powe's
credentials, the plaintiffs may pursue the chancery court proceeding.
Should that happen, the University will contest the jurisdiction and
authority of the court. We do not want a court setting our admissions
standards.
This is a difficult, very public situation. To some extent, the
University is in the middle of a fuss between Mr. Powe and the NCAA. It
is our intention to provide as much information as possible to the NCAA in
support of the University's request that the NCAA reconsider its ruling,
but should the NCAA ultimately deny eligibility and the matter then be
considered by the chancery court, we will oppose Mr. Powe's request before
the court. We do not believe that this matter should be decided by the
courts or that the courts should set admissions standards.
We are extremely sensitive to institutional control issues and are working
diligently to assure that Mr. Powe's application and his participation in
the life of this University are totally consistent with rules and
regulations that apply to every student at the University.
As other developments occur, we will provide current information to you.

regardless of if the chancellor wrote the e-mail or not, the facts are that a court order was handed down and the school has to comply, which they are doing, and no, powe is not practicing, he is a normally enrolled part-time student.

no matter what the outcome..... Jerrell Powe certainly won't be the first athlete to play for a Mississippi school by way of a court hearing...... I seem to recall Mario Austin's lawyers chewing up the NCAA and spitting them back out......
