Pledge Ruled Unconstitutional

SAN FRANCISCO (AP) - For the first time ever, a federal appeals court declared the Pledge of Allegiance unconstitutional Wednesday because of the words ``under God'' added by Congress in 1954.
The 9th U.S. Circuit Court of Appeals said the phrase amounts to a government endorsement of religion in violation of the Constitution's Establishment Clause, which requires a separation of church and state.
``A profession that we are a nation `under God' is identical, for Establishment Clause purposes, to a profession that we are a nation `under Jesus,' a nation `under Vishnu,' a nation `under Zeus,' or a nation `under no god,' because none of these professions can be neutral with respect to religion,'' Judge Alfred T. Goodwin wrote for the three-judge panel.
The appeals said that when President Eisenhower signed the legislation inserting ``under God'' after the words ``one nation,'' he wrote that ``millions of our schoolchildren will daily proclaim in every city and town, every village and rural schoolhouse, the dedication of our nation and our people to the Almighty.''
The court noted that the U.S. Supreme Court has said students cannot hold religious invocations at graduations and cannot be compelled to recite the pledge. But when the pledge is recited in a classroom, a student who objects is confronted with an ``unacceptable choice between participating and protesting,'' the appeals court said.
``Although students cannot be forced to participate in recitation of the pledge, the school district is nonetheless conveying a message of state endorsement of a religious belief when it requires public school teachers to recite, and lead the recitation of, the current form of the pledge,'' the court said.
The case was brought by Michael A. Newdow, a Sacramento atheist who objected because his second-grade daughter was required to recite the pledge at the Elk Grove school district. A federal judge dismissed his lawsuit, but the 9th Circuit ordered that the case proceed to trial.
``I'm an American citizen. I don't like my rights infringed upon by my government,'' he said in an interview. Newdow called the pledge a ``religious idea that certain people don't agree with.''
The government had argued that the religious content of ``one nation under God'' is minimal.
But the appeals court said that an atheist or a holder of certain non-Judeo-Christian beliefs could see it as an attempt to ``enforce a `religious orthodoxy' of monotheism.''

The 9th Circuit is the most liberal, and most over ruled of the federal circuits. The U.S. Supreme Court will no doubt overturn this decision. Otherwise, we will have to get rid of our currency, etc. The whole thing is silly. Very sad, but silly.

Thank goodness for Justices Rehnquist, Scalia, et al. Let's hope that "W" will have a chance to replace some of the liberals on the Supreme Court during his term!

We may not be able to change the country from going to hell in a hand basket but you can make a change in your family. It will have to be a ground roots movement and it will have to start in your family.
I made a concerted effort to become more conservative in my thinking and the way I run my family. Go read the book "The Death Of Outrage". We tolerate behavior today that our parents would not. My parents would not even allow the word "pregnant" be said in our home. I don't know who said it but it is true "What one generation allows the next generation accepts".
We can all make a difference at the polls.

My only comfort is that one day those persons responsible for these actions and those of close similarity will have to stand before the Almighty Lord and attempt to explain why they violated His law. All while He is weeping and banishing them to eterinity in Hell.

I take extreme offense to the name calling. Although I am not for the changes in these types of laws I also believe that part of our freedoms are that of expression and living our lives as we choose so long as we are abiding by the laws set forth. If we don't like it do something about it to get them changed. This is about the Athiests not the gays.

Allow me to be a redneck for a minute and agree with NO HERE. I think all the fags should be put on a island and allowed to do to each other as they wish. Only problem is one of'em has aids, and when they're all gone the good ole U.S. will be a better place. What good are they! My children still say "One Nation Under God!"

None of this really surprises me, what does surprise me is that it has taken this long to develop.
Our country carries human rights to the extreme, so much that history as proven that the minority can control the majority. It is the squeaky wheel affect. We have seen it time and again.
Look at what this country has allowed to happen in our lifetime.
Same Sex Marriages
Gay Rights
Miss Black America pageant – With no white contestants – Can’t say the same for Original Miss America
Black history month, Why not just history month
R and X Rated Movies
Urban Gangs
Open pornography
No prayer in schools
Removal of State Flags because they are offensive
Cartoons removed from viewing because they insult foreigners
Removal of certain facts from history books because it is offensive to foreigners (Alamo is an example)
Abortions legalized
PETA
Gun Control
Criminals freed because of space limits in prison
NAACP
Movie and primetime nudity and vulgarity
Work on Sunday’s
Foreign immigrants not having to learn English to become a citizen.
NEWS networks with the constant continued showing of crimes for the mentally deranged to copycat.
This is only a short list but most of all that is listed is a small group that knows how to work the system to their advantage and have changes made that cost the majority that usually don’t hold the same values.
The problem is that people are quick to complain when things finally get to the point that it affects their way of life. Why has the majority not stepped up before now and say we have to make a difference and do it now.
It is truly a said state of affairs that this country is moving to. It almost makes me wish I didn’t have kids that would end up having to deal with where it is going.
Look at what our kids are using for roll models today. People like Madonna, ICE, and others
Why this came from California it is happening all over the country and our sit back attitude will allow it to continue till we fall flat on our face. That is why it is called the American Way.

a sad state that we are in. i can only reply that i am a Judge with no jurisdiction over a matter as this. i can say that i am a Judge who has definate values that were set by the OLD BOOK.... and i stand by them on every decision that i make....{possibly the reason that i held the bench today as a special appointed Judge to hear 3 cases in Marshall Co. Ms.} i can only reach a decision based on common sence, but then again, i do not make the laws, i only punish or dismiss as the laws are written....{sad} the laws of the land and i do not always agree....
better not ever give me the power to rule in the big courts.... after all, i like the old book of justice....
