Just wanted to let you guys know a new law was passed prohibiting the use of atv's in streambeds. This means if ya gotta cross a even a small stream to get to your duck hole your S O L. This goes for public and private land. As far as I understand, you can thank your US Army Corp of Engineers for this new law. Judge, you might can fill in some spaces here, but this is what one of the local corp a-holes told me.

I think that's was because of all the joy-riding in sensitive streams. Something about how it was disturbing the fish eggs or something.

Big gun in some places this law was much needed. Gulfcoast probablly knows the area I am about to mention. A couple years ago I was working on a conservation easement along the Wolfe River in south MS. This was a 15 mile long easement and while going down it practically everyday my partner and I saw groups of atv's riding up and down the stream bed of the river. One day we even saw some young guns in 3 small 4 wheel drive pickups riding down the river. I assume if you take caution and act sensibly this law will not affect ya. I could be wrong though.

Section 51-1-4, Mississippi Code of 1972, is amended as follows:
The right of the public to use public waterways does not include the use of motorized vehicles in the beds of a public waterway without the written permission of the landowner. Any person who uses a motorized vehicle in the bed of a public waterway without the written permission of the landowner may be punished as provided in Section 97-17-93.

I agree with Peewee. This is a much needed law for people who ride up and down the streambeds. I have seen places which were in horrible condition from people joy riding!

You will need to get a copy of Miss. Code. Ann. Section 51-1-4 that defines what is a public waterway. As I recall, it is something along the lines of all natural flowing streams with a mean annual flow of not less than 100 feet per second as determined by the MDEQ. I would have to pull the statute to be sure.

i have had a few cases this year already.. law prohibits the use of recreation vehicles in streambeds or right-of-ways... my first case was a landowner who chose to walk a dozer down a creek to clear a beaver dam....

this is one more touchy subject.... the main purpose is to stop ATVs from erosion problems resulting in damage to the streams.... this subject could go on for-ever, just be wise and use your head....
