I wouldn't be so worried about the minor trespassing as I would be about the assault or murder, which could POSSIBLY (however slight) seriously injure or kill him. That's where ya start to get yo booty in trouble! Remember: You take your victim as you find him (i.e., he could have weak bones or a serious brain injury unknown to you, and you would be just as liable for his injuries as if he was the strongest boned and best brained person alive).
And yes, I believe premeditation is in order.
