Old River
Dear Readers:
The circuit court of Phillips County, Arkansas ruled on April 7, 2005 that the lands and waters of Old River are owned in fee simple absolute by Miller Point Timber Company; and, further that the general public has no right to hunt or fish upon these lands and waters.
Here is an executive summary of the court's final judgment:
· The land in question lies entirely within the state of Arkansas;
· In 1928 the State of Arkansas deeded the subject property to Sam Costen (Miller Point's predecessor in title);
· In 1931 the Federal Court in Little Rock held that the State of Arkansas has no title to any of the lands or waters of Old River;
· Miller Point is the owner in fee simple absolute to the lands and waters of Old River;
· The general public has no rights to hunt and fish upon the lands and waters of Old River.

From reading your correspondence on this website I know that there has been a great deal of speculation and misinformation about the situation at Old River. Chiefly, many of the readers and writers are of the mistaken belief that these lands and waters lie in Mississippi and that Mississippi law governs. To the contrary, these lands and waters lie completely within the State of Arkansas and Mississippi law has nothing to do with these legal issues.
I know that each of you are law abiding citizens and now that the law is clear you will abide by the court's decision.
Miller Point welcomes the public to fish on the waters of Old River. However, the lands and waters of Miller Point, including Old River, are posted to hunting.

According to USGS Quadrangle maps, the current state line between Arkansas and Mississippi, as shown on the map below, exists on or near points:

Or am I understanding you to say that the land in question as ruled by the circuit court of Phillips Co. Arkansas to be owned by Miller Point Timber Co. and posted to all hunting and fishing is only on the Arkansas side of the lake?
