That is not all of the photos from the series. There is a photo of the cat pawing at the mule, I'm sure it got lost somewhere down the email line. From the looks of that pic, the cat was very much alive. (I had the FBI digital photo department examine the photo and they assured me that the photo was viable and there was no doctoring.
Also, they said the cat had been shot once in the thigh before the pic was taken and it would not interfere with the cat's ability to fight back.
This should clear up this most important debate about whether the pic is real and no further discussion should be necessary.
