possession limit?

Postby DDT hunter » Mon Jan 10, 2005 11:25 am

This may need to be answered by Wingman or SB but can someone clear up a debate. Does the possession limit count the number of ducks in your freezer? This has been a debate I have heard several people discuss.

The short answer the way I read the regs is yes. So start legally gifting ducks to relatives!

And let me tell ya it aint cheap. Four years ago we left the boatlanding and got checked on the way to the camp. Two of us had three limits. One guy went to town to pick up some whiskey, then was going to meet us at the camp. $500 base fine, 100 bones per duck over= $800 dollar fine.

We need to demand that the USFW clear this up. This is absolute bullcrap.

Awe...lighten-up, will ya? That law was written before the advent of home refrigeration (freezers).......they did it so game wouldn't spoil before it was consumed or cured. If you really want to be a stickler and interpret it as written, then yes you could be charged........but the GW's I know have enough sense to interpret it within the context of present-day circumstances. If it's in your home (permanent place of residence), then you won't have a problem......but the hunting camp is not the same as your residence.

Yes......if there is someone at the camp while others have gone to Wal-Mart.........and the number of ducks at the camp exceeds the possession limit of those present (unless they're properly tagged......even the ones in the freezer), then they stand a perty-good chance of getting a citation for those ducks in excess of their limit. I don't know ANY officers that would write a ticket unless they had reasonable cause to suspect those folks of killing over the daily and/or possession limit.

Not if you're in AR camping out on a 5 day hunting trip. You'd better find a dumpster if you can't give them away or cook them .

Although, I suppose you could just go to two different duck pickers and then collect everything on the last day of your trip.

You'd better find a dumpster

Believe or not we had a Fed tell us that a few years ago...He was an out of towner visiting the area and was a real Dik...He opened the door to the camphouse without knocking and walked in..This is after one of the atty's in the club got pissed at him because he was crawling around in the bed of his pickup looking in the toolbox..He then came inside and started snooping around the freezer. which held a good bit of frozen ducks..Several of the camp members had been to Ark 2 weeks prior and they were packaged with the id and type on them...He counted the ducks and then counted the # of people...There were not enough people in the house to cover the posession..He then comes riding down the road on his 4 wheeler and comes to the blind I'm in to verify there were 2 more people...By that time the others had come out of the other blind and were back at camp...Long story short, he gave us trouble over clearly marked, frozen ducks...We asked what should we do in that situation he said give them away or THROW them away...He also said it didn't matter how many ducks you have in your posession at your personal residence ( I didn't understand the difference in that or your camp.)..On top of that he saw a picture of several of us with a monster pile of dead greenheads...He smartly said how many people were on that hunt...Some smartly replied 10...

Wanton Waste

Postby DeltaBum » Mon Jan 10, 2005 9:31 pm

We asked what should we do in that situation he said give them away or THROW them away

I'm suprised the Fed said that. I believe that would constitute wanton waste.

wanton waste occurs when you leave game in the field or don't make a reasonable attempt to retrieve downed birds. It doesn't say anything about the BFI dumpster. I do not advocate throwing birds out and you guys know this...just stating a point. That dumpster better be off of club property and you better feel like a selfish greedy turd if you toss them.

The law doesn't say you have to eat them (unfortunately).

Also - persons having game "gifted" to them are "supposed" to be licensed per the Fed that checked me and a buddy a few weeks back. I specifically asked if my granny had to be licensed or exempt and he said "yes" but he laughed.

I think that folks get what they deserve. If you are a jack@$$ and disrespectful then you will probably get jacked with. I know I wouldn't tolerate any lip if I were the man in green. I also think that Anat is right on point with his comments.
