Yall are making this harder than it really should be. If you shoot a duck go get the duck. If you neighbor says you can not go onto their property then do not hunt close enough to have to go onto their property. If you don't know and you are scared to walk a couple 100 yards onto anothers property to retrieve your game then call the owner. If he says no the leave it and you will be OK.

I don't want an out, just trying to stay legal. It was a legitimate question and it was somewhat answered...? We make every attempt to retrieve downed birds and I have crossed property lines to retrieve cripples. I guess I'd rather get a trespassing ticket over wanton waste. This is obviously a grey area and one in which I would hope a LEO would use his discretion when enforcing.

Wingman, we talked about this last year. A landowner that had just purchased land on one side of a Ms. riverchute walks down the edge with his hunting partner, puts out a few decoys with his buddy. They did not have a boat, just waders. They commenced to shoot ducks in the grass on the far side. Silt was neck deep, and they were definately not going to retrieve the ducks. Just left them there. When I came by in a small boat, they accused me of being a poacher. I went down towards the river and killed a nice 4 mallard, 2 gadwal limit. Came back by and the ducks were still there. They were there till they rotted. Heard them fire about 3 or 4 shots the other morning, most likely doing the same thing.

Wanton Waste for sure.
