ATF Interview for FFL

Postby woody » Fri Aug 16, 2013 11:34 am

Just finished my interview with ATF for my FFL! Seems like it went well. He said if approved it should be about a month or so for license to come in! Pumped up to say the least!

Careful.. Since getting my FFL in January it seems I have a real hard time selling some of the guns I get in... :D :D :D :D .. Some I just like too much to let go..

Oh.. And holler at me if you need some help getting set up with distributers.. I can sometimes be a little difficult if you don't actually have a Store front

yeah just a side gig...

Thanks cwink. I'm not sure if I'll have an inventory. Probably not. Well not until I get SOT, then I'll try to keep a few cans in stock.

How hard was it to get the deal done? I have been thinking about getting mine. At some of our events we auction or give away guns it would be nice to do the paper work then and not have to go to local gun dealer during the week to do it. I know its a hassle for them and they are nice enough to do it. Is there a min on how many guns you have to buy/sell a year?

No minimum.. But there are some drawbacks to doing it on the side.. I had to get a sales tax licensce here in MS and since I work out of my home it cost $500.00 for that. Also, some distributors wont work with you if you have a home business instead of a store front so that limits your places and some require a minimum first order..

Also, if you have it set up out of your home, don't you have to do all transactions there at your home (i.e. the address listed on your FFL) w/few exceptions if any?

I know FFL's operate at gun shows(not really sure how since it isn't their home/FFL/store address), but I was curious about it as well for myself and didn't know if the same would apply for what Faithful Retrievers was wanting to do where he could actually conduct the transactions wherever they hold the event.

I know alot of local FFL's that operate on their residence property buy a small 12ft x 12ft building and that is their "store". Maybe that is a workaround to having the whole store front?

Yes that is true.. You are supposed to do the transactions at the address listed on the FFL.

I had my FFL for many years and only recently gave it up. When Bill Clinton was elected I knew we were phookkked, then Janet Reno, Brady Bill NICS checks etc. It just got worse and worse.

Faithful Retrievers - You can transfer guns at certain off-site events, DU/Delta waterfowl fundraisers being among them. It gets tricky when that influential big money bidder is either delayed or denied. (worse if he is denied three days later after the event). Now you are on the spot with the bad news and the event has to refund and/or scramble a plan "B" to bidder #2 if that is even a known entity. Mr. Money man can't leave with the gun even though he paid thousands. (You would be surprised at the background of some phat cats)

cwink is right about the tax, that tax thing is a headache. If you convert inventory to your personal collection you are supposed to pay tax on those items. Continually submitting "zero tax owed this month" is a red flag.

If you do not completely separate and label your personal collection from your inventory "on the books", the ATF will not be happy upon inspection. Oh yeah, you will sign away your 4th amendment right to government searches of your home. It doesn't matter if you have an outbuilding as storefront, separate office inside, they can search anywhere they please at that address. You will be told that "they" (ATF) can only come during your stated business hours (on the form you submit) but don't count on that. They arrive at their convenience, not yours. If the President comes to town, make the place look spiffy for the guys in cheap suits. When Bush was going to visit Peavey in Meridian about 1991, I pulled into the driveway and thought someone had died. Nope just the G-men saying hello. My wife was not smiling either.

Also - Every delivery now requires an adult signature. If nobody is "home" it may be returned to sender or at the local UPS/FedEx hub in the lockup. Real convenient. Handguns arrive overnight delivery because the UPS hubs (Memphis) employed gang thugs and so much was getting stolen, with UPS on the hook for the $$$ and the liability, they changed the policy.

My drivers just brought the packages to my place of employment as a convenience to us both(they all knew me). Well, not only was that a little awkward, it was also illegal because they must deliver to the FFL address with no variation.

Choose your FFL address wisely and regardless of what's going on today, their will be new administrations, attorney generals and changes.

I gave up my FFL because I live so rural, delivery was a burden on everyone, and most guns I wanted were old ones at market value. It's hard to buy a Python, a Garand, or a 1940's High Standard at wholesale. The plastic guns never caught my interest. Also, any boo-boo on the paperwork, NICS, bound books, or taxes and you potentially got serious lawyer trouble. Again, potentially, depends on who is President and attorney general.

Seriously though, I would do it again. BUT, I just wanted to point out some complications folks may not consider.
