Old River

Dear Readers:

The circuit court of Phillips County, Arkansas ruled on April 7, 2005 that the lands and waters of Old River are owned in fee simple absolute by Miller Point Timber Company; and, further that the general public has no right to hunt or fish upon these lands and waters.

Here is an executive summary of the court's final judgment:

· The land in question lies entirely within the state of Arkansas;
· In 1928 the State of Arkansas deeded the subject property to Sam Costen (Miller Point's predecessor in title);
· In 1931 the Federal Court in Little Rock held that the State of Arkansas has no title to any of the lands or waters of Old River;
· Miller Point is the owner in fee simple absolute to the lands and waters of Old River;
· The general public has no rights to hunt and fish upon the lands and waters of Old River.

From reading your correspondence on this website I know that there has been a great deal of speculation and misinformation about the situation at Old River. Chiefly, many of the readers and writers are of the mistaken belief that these lands and waters lie in Mississippi and that Mississippi law governs. To the contrary, these lands and waters lie completely within the State of Arkansas and Mississippi law has nothing to do with these legal issues.

I know that each of you are law abiding citizens and now that the law is clear you will abide by the court's decision.

Miller Point welcomes the public to fish on the waters of Old River. However, the lands and waters of Miller Point, including Old River, are posted to hunting.

I don't hunt there, so I have no beef, but isn't this the same thing that was posted last fall in the Clarksdale Press Register. Did the public hunt there this year? Is the boat ramp that is within 100 feet of the Mississippi Levee in Arkansas? Where is the line?

Is you Michael Lewis of football fame? I knew some one with a lot of money would get the rights to all that land at the expense of us poor cracker hunters from MS! :shock:

Aint never hunted out there before... Believe i'll have to take a crack at it this next go round. Aint never been much on being told where I can and can't go on Old Man River.

Sure you have... you remember that time we road the river north and killed that boatload pintails and canvasbacks on December 20th and you asked where we were? :shock:

A 662 area code, huh? I bet you are the hometown hero, fighting against all your good 'ol MS buds. :shock: I would also be willing to bet that you might somehow have a stake in the hunting rights to that place. Seems to me, Mississippi law kinda has a way of regulating everywhere MS boys go. :P

Disclaimer: The part about the pintails and cans was just in good fun. I am a law abiding citizen and have never hunted north of Mayersville, MS. :o

Chuckle... I thought you knew that when the river stage was up that that's just more water to hunt !

I can elaborate on the hometown hero thing. Mike Lewis lives and works in Clarksdale. He gets his fame from tobacco company lawsuits, which, if I'm not mistaken, made him a smooth 20 mil or so.

If these coordinates are inaccurate and the circuit court of Phillips Co., AR has ruled that the boundary between AR and MS has moved, would you please post the new/ correct coordinates?

Or am I understanding you to say that the land in question as ruled by the circuit court of Phillips Co. Arkansas to be owned by Miller Point Timber Co. and posted to all hunting and fishing is only on the Arkansas side of the lake?
