I was recently asked by a friend to sign a waiver for my children and myself to hunt and/or visit their club. That reminded me of a lawsuit at the Mississippi Supreme Court that I had heard about a while back, but just now found that it had been ruled upon in January.
The case involved a terrible situation of a 14 year old who was killed in a 4-wheeler accident on a hunting lease. No one was with him to know what happened. The suit was filed against the operator of the hunting camp and a trust that held/owned the property. Part of the claim was that the camp did not impose rules on minors regarding ATV use. The court found no legal duty to have such rules in place, and the case was to be dismissed.
The ruling is here if anyone wants to read it - http://statecasefiles.justia.com/docume ... 1389362697
Just a heads up for hunting camps - If you know of a hidden/dangerous condition on your property, you better warn everyone and sufficiently mark it. And if you have rules in place about minors on ATV's, you better enforce them.
Deer camp operator/owner not liable for kid's death
Re: Deer camp operator/owner not liable for kid's death
That's just sorry as hell to think you should sue someone b/c your kid wrecked your 4wheeler, and they didn't have a rule telling you not to let him/ her ride it. Pussification of America at its finest...

I was thining the samething Trip...pretty sorry world we live in today when you gotta be worried about being sued for anything..... It sucks that a boy was killed, but how was it remotely the camp's fault or the landowner's fault... The pussification of America is exactly waht it is...always gotta blame somebody else and try to exploit them for money to ease your "pain and suffering"

when all of the yamaha rhino suits were going on, a guy at the camp was in found out towards the tail-end of all the bs and asked me to let him drive mine (no: doors, seatbelts, chicken-bar, tortion bar, helmet) so he could flip it and file a law suit.....NO, duh!!!!!
Experience is a freakin' awesome teacher...

And folks wonder why it's harder to gain permission to access land.
Can't say I blame them.

This is one of the main reasons its so damn hard to get permission to train dogs on anyone's land.
