Legality of business moving locations.

Postby H20fowlkiller » Tue Apr 30, 2013 8:02 am

I'm not talking about across town. I mean moving around 60 miles away. What does a company legally have to offer you if anything for compensation to move.

Im pretty sure in MS they can let all of you go if they want to and hire new at the new location. You are not protected as an employee here. Thats one of the reasons why the big names come here to open plants.

Thanks for the help, not the answer I wanted but at least I have a heads up. Severance packages are not even mandatory?

Thaaat's right. Mississippi is a "Right To Work" State. You have the right to work anywhere you want. You have the right to leave any time you want, for any reason you want. And in most cases, it works the exact same way for the employer.
Nobody owes you anything.

You can fire an employee for no reason in the state of Mississippi. If you do though the exempllyee will collect unemployment through the state against your company and the company unemployment rate that is charged by the state will go up. So its better to have two or three reasons to fire someone documented and signed before terminating them.

We're getting hosed on the unemployment as well. We were 'nice' and didn't contest when we let a couple people go, they filed and we're getting hit with thousand$ in unemployment taxes/fees.

The above is true, MS is an "at will" state - meaning you can be fired with or without cause (subject to certain things). However, if you have a specific employment contract, read the contract and that will control most of the issues such as firing, with or without cause, and other matters such as relocation or severance.

Are you with PHI, or ERA? Just asking because ERA has a couple birds at our place in Mobile, which is about the distance you're talking about. I see those poor guys get moved all over the place all the time. Basically, you'll have to move where the job moves, or find another job. I've been on both sides of that equation, as both employee and employer. Unfortunately for both sides, the aviation world, and the oil field helicopter business in particular just work like that. Keeping pricing reasonable in the customers mind means keeping cost as low as possible and often means moving your base of operations in order to keep contracts.

I fly with Panther Aviation out of Belle Chase, stationed in Picayune. But we have our own hanger between Chalmette and Delacroix.
